1.              Definitions.

A.            Non-Personal Information is information that is in no way personally identifiable and that is obtained automatically through the simple use of our Website with a Web browser.

B.             Personally Identifiable Information is non-public information that is personally identifiable and obtained in the course of providing a product or service to you.  It may include such information as your name, address, phone number, and financial data you provide to us.

2.              Collecting Non-Personal Information.

Our primary purpose in collecting any information from you is to enable us to effectively meet your needs and provide you an efficient and effective experience on our Website.  By gathering information from our visitors, we can provide the services and features that best meet our visitors’ needs, and we can customize our service in an effort to make your experience an enjoyable one. We only collect information about you that we consider necessary for achieving this purpose.

Non-Personal Information is information gathered while the visitor remains anonymous.  It is largely obtained through the use of internet technologies.

A.            Internet Technology.

E.             Sponsors or Advertisers.

Sponsors or advertisers on the Website may use their own cookies, Web beacons or other online tracking technologies in the banner advertisements on our Website, in emails, special promotions or newsletters we send you.  Some advertisers use companies other than us to serve their ads and to monitor users' responses to ads, and these companies (“Ad Servers”) may also collect Non-Personal Information through the use of cookies or Web beacons on our Website.  In certain situations, information collection may be facilitated by momentarily directing your browser to the website of an Ad Server or other third party acting on behalf of the sponsor, partner, or advertiser before re-directing your browser to its selected destination (e.g., back to our Website to show the ad, or to the advertiser’s website); this re-direction process will not be apparent to you.

We do not control these third parties’ use of cookies or Web beacons, or how they manage the Non-Personal Information they gather through them.  However, we do require sponsors, advertisers and Ad Servers who collect cookie or Web beacon information through our Website to agree that they will not collect any Personally Identifiable Information from our Website without your consent.  They must agree that they will not link any cookie or Web beacon information collected by them on our Website to Personally Identifiable Information that they or others have collected in other ways or from other sites except as may be described in connection with a particular program.

F.             Web Beacons.

The information collected by Web beacons (i) allows us to statistically monitor how many people are using our Website and selected sponsors' and advertisers' Websites; (ii) how many people open our emails; and (c) for what purposes these actions are being taken.  Our Web beacons are not used to track your activity outside of our Website or those of our sponsors.

G.            Log Files.

Like most standard web Website service providers, we use log files. These files include internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks.  The data in the log files, all of which is Non-Personal Information, is used to analyze trends, administer the Website, track users’ movement in the aggregate, make inventory purchasing decisions that will best serve our customers, and gather broad demographic information for aggregate use.

H.            Automatic Tracking.

We automatically track certain information based upon your behavior on the Website. We use this information to do internal research on our users’ demographics, interests, and behavior to better understand, protect and serve you.

I.               Clear Gifs (Web Beacons/Web Bugs).

We employ a software technology called clear gifs, also referred to as web beacons or web bugs that help manage content on our Website by tracking what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users.  In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence.

We use clear gifs in our HTML-based emails to let us know which emails recipients have opened. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these emails, please see “Choice and Opt-out.”

3.              Collecting Personal Information.

A.            Registration.

Although you can browse some sections of the Website without being a registered user, certain activities including, without limitation, renting garments from the Company, do require registration in which you will create a user name and password and provide certain Personally Identifiable Information.  We use this Information to contact you about the products and services on our Website in which you have expressed interest and to fulfill orders which you may place.  Once you give us your Personally Identifiable Information, you are no longer anonymous to us.

Information which we may gather includes the following

(A.i)       Your contact information such as name, email address, address and telephone number;

(A.ii)     Your financial information such as credit card number and expiration date;

(A.iii)    Additional information we may ask you to send or questions we may ask you to answer to verify your identity, such as your driver’s license number or credit card statement;

(A.iv)    Information based on your activities on the Website, such as search information, computer sign-on data, statistics on page views, traffic to, from and within the Website, ad data, and IP address and standard Web log information;

B.             Contests and Surveys.

In the event we hold contests or conduct surveys, we may use Personally Identifiable Information to notify contest winners and award prizes, to monitor Website traffic, or to personalize the Website (in the case of anonymous information collected in surveys) and to send participants an email newsletter.  If we use a third party service provider to conduct these surveys or contests; that provider may not be prohibited from using our users’ Personally Identifiable Information for any other purpose.

C.             Referral Service.

In the event we offer a referral incentive or bonus and you refer someone to our Website, we will ask you for that person’s contact information.  We will then send your referral a one-time email inviting him or her to visit the Website.  The Company stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.  Your referral may contact us at info@petiteseatsnj.comto request that we remove this information from our database.

D.            Blog Post Comments/ Discussion Boards.

If you choose to post messages or leave feedback for other users through our Website, we will collect the information you post. We will retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by law.

We will send you a welcoming email to verify your username and password, using the Personally Identifiable Information you provide us.   We will use such Information to respond to your inquiries, to provide the services you request, to manage your account, and to provide you general customer service.

We will store Non-Personal Information that we collect through cookies, log files, clear gifs and similar technology to create a “profile” of your preferences.  We may also link your Personally Identifiable Information and your purchasing history to information contained in your profile, in order to provide promotions and offers specific to you and to improve the content of the Website for you.  We do not share your profile with other third parties.

We may use third party software for verification of your identity and address and to ensure proper shipping and billing procedures for your rental.

5.              Use of Your Information.

A.            Your Profile.

When you register as a Member with us, you create your own profile containing Personally Identifiable Information.  Your profile is used solely to tailor your requested services from our Website, though we may occasionally use your name and email address to send you notifications regarding new services we offer that we think you may find valuable.  Except as otherwise provided in this Privacy Policy or you otherwise consent, we do not share your profile with any third parties.  Profile information is used by the Company primarily to be presented to and edited by you when you access our Website and to be presented to others permitted to view that information by your use of our Website. 

B.             Accuracy and Updates.

You are responsible for ensuring the accuracy of the Personally Identifiable Information you submit to us.  Inaccurate information will affect the information you receive when using our Website, your ability to purchase products and services from our Website, and our ability to contact you as described in this Privacy Policy (i.e. your email address should be kept current).  Should any user intentionally submit false or fraudulent information, the user’s offer and related guarantee may be deemed null and void.

6.              Accessing, Reviewing and Changing Your Personal Information.

You can review and change most of your personal information by logging into the Website and editing your Account Profile.  Generally we will not manually modify your personal information because it is very difficult to verify your identity remotely. You must promptly update your personal information if it changes or if it is inaccurate.

Upon your request, we will close your account and remove your personal information from view as soon as reasonably possible based on your account activity and in accordance with applicable law. We do retain personal information from closed accounts in order to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms and Conditions [3], and take other actions otherwise permitted by law.

7.              When We May Disclose Your Information.

Except as set forth below or unless you specifically agree, we will not disclose any Personally Identifiable Information gathered from you on our Website.

A.            To Operate Our Website.

To meet your needs for a wide choice of quality products and services, and for certain other reasons, we may share your Personally Identifiable Information with members of our corporate family of companies and others as described below in Paragraphs B through F.  However, legal restrictions on sharing information apply if your address registered with us is in Vermont or California as described below in Paragraph G.

B.             Contractors and Service Providers.

D.            Service Providers.

We may share Personally Identifiable Information with service providers under contract who help with our business operations (such as fraud or theft investigations, web development, marketing, bill collection, invoicing, and affiliate and rewards programs).

E.             Transfer of Ownership.

We may transfer or assign your Personally Identifiable Information to another business entity should we merge with, be acquired by, or sell substantially all of our assets to that business entity. Should such a transaction occur, that other business entity (or the newly combined entity) will be required to follow this Privacy Policy with respect to your Personally Identifiable Information.

F.             Affiliates and Business partners.

We may share Personally Identifiable Information we collect with affiliates and other third parties that are non-financial service providers (such as catalogers, retailers and publishers), financial service providers (such as insurance companies, and credit card issuers), and others (such as non-profit organizations).  For example, we may share information with our affiliates and others for the purpose of providing you with offers that may be of interest.

G.            Exceptions.

If your registered address with us is in Vermont, we will not share information with affiliates and third parties as described in Paragraph F.  If your address with us is in California, we will not share information with third parties as described in Paragraph F, nor will we share information with financial institutions that are not our affiliates with whom we have joint marketing agreements as provided in Paragraph B.

H.            Opting Out.

If you prefer that we not share certain information with our contractors and service provider, as described above, you may direct us not to share that information by contacting us.   Please note that an opt-out with respect to information sharing will not apply to information sharing arrangements described Paragraph s B or C above.

I.               Other Websites.

We may also provide content and services to you through websites other than our own.  We will not disclose your Personally Identifiable Information to these third party websites without your consent.  When visiting these other websites you should be aware that any information you disclose on such sites is not subject to this Privacy Policy.  We will use our best efforts to inform you when you leave the Website and enter another website.

To purchase products and services from our Website, you may have to provide a credit or debit card for billing purposes.  All payments are processed via Secure Socket Layer and are fully encrypted.  We do not store credit card information.  We use a top-tier billing service provider for credit card processing.  We use our best efforts to make sure that your credit card number is kept strictly confidential by using only billing service providers that use the latest security encryption technology to protect your credit card number from unauthorized use.  However, you understand and agree that we are in no way responsible for any misuse of your credit card number.

10.           Conditions Under Which We Share Information

A.            Non-Personal Identifiable Information.

We may share aggregated demographic information regarding our Members and other visitors to our Website with select third party business partners.  This information is all Non-Personal Identifiable Information and we do not link any of this aggregate user data with Personally Identifiable Information.  For example, we may use information gathered to create a composite profile of all the users of a particular third party site.  Depending on the circumstances, we may or may not charge business partners for this aggregate information.  We require parties with whom we share aggregate information to agree that they will not attempt by any means to transform such information into Personally Identifiable Information.

B.             Personally Identifiable Information.

Our Privacy Policy does not apply to any information you may send to the Website by email or instant messaging programs (i.e. AOL, Yahoo, etc.), as email and instant messages are not recognized as secure communication forms.  As such, we request that you do not send to us by email or instant message any information, which you consider private.

We may co-market our Products or products of one of our designers or partners by sending you e-mails, where you have previously evidenced interest in the products of that designer or partner.  For instance, we may send an e-mail to all customers who have previously rented a dress from Designer X, advertising the launch of their new product line or the availability of a new product, designed by Designer X, on our Website.  We do not provide your e-mail address or other Personally Identifiable Information to those designers or partners.

18.           Choice/Opt-out.

20.           Market Research.

From time to time the Company or contractors and service providers operating on our behalf, may conduct online research surveys in order to gather feedback about our Website, our sponsors and opinions on important issues.  Information may be gathered through email invitations, pop-up surveys, online focus groups or similar means.  When participating in a survey, we may ask you to submit Personally Identifiable Information.  This Personally Identifiable Information is used for research purposes, and is not used for sales solicitations.
